Yes. The 15% credit is fully refundable — it is applied against total taxes payable first, and the amount in excess of tax otherwise payable is refunded to you. New Brunswick made it refundable specifically for R&D companies with no taxable income.
How much is the New Brunswick R&D tax credit worth?
15% of eligible expenditures, with no published cap. The rate rose from 10% to 15% effective January 1, 2003, when the credit was also made fully refundable; before that the 10% credit was non-refundable and had to be carried forward or back.
Does the research have to happen in New Brunswick?
Yes. You need both a permanent establishment in New Brunswick and eligible expenditures for research and development to be carried out in New Brunswick. A provincial address without provincial R&D activity does not qualify.
Which form do I file?
Schedule 360, New Brunswick Research and Development Tax Credit, filed with your corporate return, and the amount claimed is entered on line 597 of Schedule 5. The credit is administered by CRA, reachable at 1-800-959-5525.
Can the credit be taken back later?
Yes. If you dispose of a property used in research and development, or convert it to commercial use, you may have to report a recapture — calculated on Schedule 360 and entered on line 573 of Schedule 5 — which creates or increases New Brunswick tax otherwise payable.
